Terms of Service

Welcome to Parkera, an application provided by Treffas AB, a company registered in Sweden (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Parkera mobile application (“App”). By using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Definitions

• “App” refers to the Parkera mobile application for iOS and Android.
• “Company” refers to Treffas AB, a company registered in Sweden.
• “User” refers to any individual who accesses or uses the App.
• “Services” refers to all features and functionalities provided by the App, including parking sign scanning, AI analysis, and related tools.
• “Credits” refers to the in-app currency used to perform scans.
• “Subscription” refers to a recurring paid plan granting unlimited or extended access to Services.

2. Availability

Parkera is distributed through the Apple App Store and Google Play. Your use of Parkera is also subject to the respective store’s terms and conditions:

3. Eligibility

You must be at least 13 years old to use this App. By using the App, you confirm that you meet this requirement. If you are under 18, you must have parental or guardian consent.

4. License to Use the App

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes.

You may not:

• Modify, reverse-engineer, decompile, or create derivative works based on the App.
• Use the App to develop a competing service or product.
• Resell, sublicense, or redistribute the App's services without written permission.
• Use automated systems (e.g., bots, scrapers) to access the App or its AI analysis features.
• Attempt to circumvent the credit or subscription system, including by creating multiple accounts to obtain free credits repeatedly.

5. User Responsibilities & Disclaimer

The App provides AI-based interpretations of Swedish parking signs for informational purposes only.

• The App does not guarantee 100% accuracy in its parking sign analysis.
• Users must independently verify parking rules with local authorities, official signage, or the relevant municipality before making parking decisions.
• Treffas AB is not liable for any parking fines, penalties, towing fees, or legal consequences resulting from reliance on the App's analysis.
• Road and parking regulations may change. Always exercise independent judgment.

6. No Account Required

You do not need to create an account to use Parkera. Each device receives an anonymous identifier on first launch, used solely to manage your subscription or credit pack. You are responsible for:

• The use of the App on your device.
• Notifying us of any concerns at [email protected].

7. Free Scans & In-App Purchases

The App operates on a freemium model:

• New users receive 5 free scans on first launch.
• Additional scans require either purchasing a Credit Pack or activating a Subscription.

Refund Policy:

• Credit packs and subscriptions are non-refundable once purchased, except where required by applicable law.
• Unused credits are forfeited upon termination of your access.

Abuse Prevention: Attempts to circumvent the credit or subscription system to repeatedly obtain free credits are strictly prohibited. Detected abuse may result in permanent suspension of access and forfeiture of all credits.

8. Subscriptions

Auto-Renewal Disclosure

All auto-renewing subscriptions, including the Parkera Yearly plan, renew automatically at the end of each term unless cancelled at least 24 hours before the end of the current period. The renewal charge is the then-current price published in the store listing.

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions renew automatically until cancelled.
• You can manage your subscription and turn off auto-renewal in your App Store or Google Play account settings at any time.
• No refund is offered for the current subscription period; access continues until the end of the paid term.

Cancelling Your Subscription

You can manage, pause, or cancel your subscription at any time through your device’s app store settings:

• iOS: Settings → [your Apple ID name] → Subscriptions → Parkera → Cancel Subscription. You can also access this via the App Store → your profile → Subscriptions.
• Android: Google Play → your profile → Payments & subscriptions → Subscriptions → Parkera → Cancel subscription.

If you cancel, you retain access until the end of the current billing period. Cancelling does not remove any unused scan credits you have purchased — those remain available for use.

9. Temporary Data Storage for AI Improvement

When you upload an image of a parking sign, the image may be stored for up to 12 months to improve the App's AI model, test new features, and fix bugs.

• All stored images are anonymized and not linked to your personal identity.
• No personally identifiable information (e.g., faces, license plates) is intentionally stored.
• After 12 months, all images are automatically deleted.

10. Third-Party Services

The App integrates the following third-party services. By using the App, you also agree to their respective terms:

• OpenAI API — AI-based parking sign analysis
• Google Firebase Cloud Messaging — Push notifications
• Google ML Kit — On-device OCR
• RevenueCat — Subscription and purchase management
• Apple App Store (iOS) and Google Play (Android) — App distribution and billing

11. Intellectual Property

All content, design, code, trademarks, and branding within the App are the property of Treffas AB and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

12. Termination of Access

We reserve the right to suspend or permanently terminate your access to the App if:

• You violate these Terms.
• You engage in fraudulent, abusive, or harmful behavior.
• We are required to do so by applicable law or legal order.

Upon termination, any unused purchased credits will be forfeited and non-refundable.

13. Resetting Your Data

You may reset the App or uninstall it at any time. Upon doing so:

• Local data such as scan history and your anonymous identifier are removed from your device.
• Any unused credits or active subscriptions will be forfeited and are non-refundable.
• Your subscription must be cancelled separately via the App Store (iOS) or Google Play (Android) to stop future billing.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

• Treffas AB provides the App “as is” without warranties of any kind.
• We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App.
• Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

15. Changes to These Terms

We may update these Terms periodically. The latest version will always be available at getparkera.app/terms. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of significant changes via the App.

16. Governing Law & Dispute Resolution

These Terms are governed by Swedish law. Any disputes arising from or related to these Terms or the App shall be resolved exclusively in Swedish courts, with Stockholm District Court as the court of first instance.
